Acceptable Use & WhatsApp Policy

InstaChatbot is built on the WhatsApp Business Platform. Everyone using it agrees to Meta's WhatsApp Business Messaging Policy and Commerce Policy. This page sets out what that means in practice and what our product enforces for you.
1. Consent is required before any marketing message
You may only send marketing messages to people who gave you permission to contact them on WhatsApp. InstaChatbot enforces this at the product level:
- A contact created because someone messaged you starts opted out. An inbound message opens Meta's 24-hour service window — it is not marketing consent.
- Consent is recorded with a timestamp and its source, so you can evidence it if challenged.
- Campaigns are sent only to contacts explicitly marked as opted in.
2. Opting out always works
- A reply of STOP (or UNSUBSCRIBE, CANCEL, OPT OUT) unsubscribes that contact immediately.
- Opt-outs are processed before keyword rules, before AI replies and before plan limits — so they work even on a paused or over-quota account.
- You cannot re-subscribe a contact on their behalf; they must send START themselves.
- Marketing templates should tell people how to opt out. We prompt for this when you write one.
3. Templates and the 24-hour window
Outside the 24-hour customer service window, WhatsApp permits only message templates that Meta has reviewed and approved. InstaChatbot will not send a campaign on a template that is not in an approved state, and free-form text is never sent outside the window.
4. Prohibited use
You may not use InstaChatbot to:
- Message people who have not opted in, or who have opted out.
- Buy, scrape, or otherwise obtain phone number lists without consent.
- Promote anything in Meta's prohibited categories — including alcohol, tobacco, drugs, weapons, adult content, gambling, unapproved supplements, or real-money financial products that breach the Commerce Policy.
- Send misleading, fraudulent, or deceptive content, or impersonate another business.
- Circumvent rate limits, opt-out handling, or template review — including by rotating numbers to evade a block.
- Send content that is unlawful, harassing, hateful, or infringes someone's rights.
5. Your responsibilities
- You are the data controller for your customers' phone numbers and messages.
- You must have a lawful basis to hold and message those contacts, and keep evidence of consent.
- You are responsible for the accuracy of what your rules and templates say.
- Meta bills you directly for conversations; those charges are not ours.
6. Enforcement
If we find an account breaching this policy or Meta's, we may pause campaign sending, disable the shop, or close the account. Serious or repeated breaches are reported to Meta, who may independently restrict or remove your WhatsApp Business Account. Where possible we warn first and give you a chance to fix it.
7. Reporting abuse
If you received an unwanted message from a business using InstaChatbot, reply STOP to that message to unsubscribe, then tell us at TODO: support@instachatbot.online so we can investigate the sender.
